Terms of service
These Terms of Use (hereinafter referred to as "the Terms") stipulate the terms of use of the services (hereinafter referred to as "the Services") provided on this website by the Kyoto International Friends Committee (hereinafter referred to as "our organization"). Registered users (hereinafter referred to as "Users") must use the Services in accordance with these Terms.
Article 1 (Application)
This agreement applies to all relationships between the user and the company regarding the use of this service.
In addition to these Terms, the Company may make various provisions regarding the Service, such as rules for use (hereinafter referred to as "Individual Provisions"). Regardless of their name, these Individual Provisions shall constitute part of these Terms.
In the event that the provisions of these Terms and Conditions conflict with the provisions of the Individual Provisions in the preceding Article, the provisions of the Individual Provisions shall take precedence, unless otherwise specified in the Individual Provisions.
Article 2 (User Registration)
In this service, the person who wishes to register agrees to these terms and conditions, applies for registration by the method specified by the Company, and the registration is completed when the Company approves it.
If the Association determines that an applicant for user registration has any of the following reasons, the Association may not approve the application for user registration and shall not be obligated to disclose the reasons therefor.
When false information is provided when applying for user registration When the application is from a person who has violated these terms and conditions When the Association otherwise determines that user registration is inappropriate
Article 3 (Management of User ID and Password)
Users are responsible for properly managing their user IDs and passwords for this service.
Users may not, under any circumstances, transfer or lend their user ID and password to a third party, or share them with a third party. If a user ID and password combination matches the registered information and is used to log in, the Company will consider that the user ID is being used by the user who registered it.
The Company shall not be liable for any damages caused by a third party using the user ID and password, except in cases where the Company is guilty of intentional or gross negligence.
Article 4 (Usage Fees and Payment Methods)
The user shall pay the usage fee separately determined by the company and displayed on this website as the price of the paid part of this service by the method specified by the company.
If the User delays payment of the service fee, the User shall pay late payment charges at the rate of 14.6% per annum.
Article 5 (Prohibitions)
When using this service, Users are prohibited from engaging in the following acts.
Actions that violate laws, regulations, or public order and morals Actions related to criminal activities Actions that infringe on copyrights, trademarks, or other intellectual property rights contained in the content of this service, etc. Actions that destroy or interfere with the functions of the servers or networks of this Association, other users, or other third parties Actions that commercially use information obtained through this service Actions that may interfere with the operation of this Association's services Actions of unauthorized access or attempts to unauthorized access Actions of collecting or accumulating personal information, etc. about other users Actions that use this service for illegal purposes Actions that cause disadvantage, damage, or discomfort to other users of this service or other third parties Actions of impersonating another user Promotion, advertising, solicitation, or sales activities on this service that are not approved by this Association Actions with the purpose of meeting members of the opposite sex who the person has not met Actions that directly or indirectly benefit anti-social forces in relation to this Association's services Other actions that this Association deems inappropriate
Article 6 (Suspension of provision of the Service, etc.)
If the Company determines that any of the following circumstances exist, it may suspend or interrupt the provision of all or part of the Service without prior notice to the user.
When maintenance, inspection or updates are performed on the computer system related to this service When it becomes difficult to provide this service due to force majeure such as earthquakes, lightning strikes, fires, power outages or natural disasters When computers or communication lines are stopped due to an accident When the Company otherwise determines that it is difficult to provide this service The Company shall not be liable for any disadvantage or damage suffered by users or third parties due to the suspension or interruption of the provision of this service.
Article 7 (Restrictions on Use and Cancellation of Registration)
If the user falls under any of the following, the Company may, without prior notice, restrict the user from using all or part of the Service or cancel the user's registration.
If you violate any of the provisions of these Terms and Conditions; If it is discovered that there is a false fact in the registration information; If there is a failure to pay fees or other obligations; If you do not respond to contact from the Association for a certain period of time; If you have not used the Service for a certain period of time since your last use; If the Association otherwise determines that use of the Service is inappropriate; The Association shall not be liable for any damages incurred by the User as a result of any action taken by the Association pursuant to this Article.
Article 8 (Withdrawal)
A user may withdraw from this service by following the withdrawal procedure set forth by our company.
Article 9 (Disclaimer of Warranties and Disclaimers)
The Company does not guarantee, either explicitly or implicitly, that the Service is free from actual or legal defects (including defects regarding safety, reliability, accuracy, completeness, validity, suitability for a specific purpose, security, etc., errors and bugs, infringement of rights, etc.).
The Company shall not be liable for any damages incurred by the User due to the Service, except in cases where such damages are caused by the Company's willful misconduct or gross negligence. However, this disclaimer shall not apply if the contract between the Company and the User regarding the Service (including these Terms and Conditions) is a consumer contract as defined by the Consumer Contract Act.
Even in the case specified in the proviso of the preceding paragraph, the Company shall not be liable for any damages caused to the user due to default or tort due to the Company's negligence (excluding gross negligence) that arise from special circumstances (including cases where the Company or the user foresaw or could have foreseen the occurrence of damages). In addition, compensation for damages caused to the user due to default or tort due to the Company's negligence (excluding gross negligence) shall be limited to the amount of the usage fee received from the user in the month in which the damage occurred.
The Company shall not be liable for any transactions, communications, or disputes that arise between the User and other Users or third parties regarding the Service.
Article 10 (Changes to Service Content, etc.)
The Company may change, add or abolish the contents of this service with prior notice to the user, and the user shall agree to this.
Article 11 (Changes to Terms of Use)
The Association may change these Terms and Conditions without obtaining the consent of each User in the following cases:
When changes to these Terms and Conditions are in the general interest of users.
When the change to these terms and conditions does not contradict the purpose of the Service Agreement and is reasonable in light of the need for the change, the appropriateness of the content after the change, and other circumstances related to the change.
Article 12 (Handling of Personal Information)
The Company will handle personal information acquired through the use of this service appropriately in accordance with the Company's "Privacy Policy."
Article 13 (Notice or Contact)
Notification or communication between the user and the Company shall be made by the method specified by the Company. The Company shall notify or contact the currently registered contact information as valid, unless the user notifies the Company of a change in accordance with the method separately specified by the Company, and shall consider that the notification or contact has reached the user at the time of transmission.
Article 14 (Prohibition of Transfer of Rights and Obligations)
The user cannot transfer or provide as security the status under the contract or the rights or obligations under this agreement to a third party without prior written consent of the Company.
Article 15 (Governing Law and Jurisdiction)
The interpretation of these Terms and Conditions shall be governed by Japanese law.
In the event of a dispute regarding this service, the court having jurisdiction over the location of the head office of the Association shall have exclusive jurisdiction.
